BiasharAI privacy policy

BiasharAI is a WhatsApp shop assistant for small shops in Kenya. A shop connects its WhatsApp number to BiasharAI. BiasharAI then answers that shop's customers, takes their orders and tells the shop owner what was asked and sold. This policy explains what we collect when you message a shop that uses BiasharAI, or when you run a shop on it, and what we do with it.

What we collect
- Your WhatsApp number and profile name, as WhatsApp gives them to us when you write to a shop.
- The messages you exchange with the shop: text, photos, documents and locations you send, and the replies you receive.
- Order details: the items, the amounts, the delivery area and address you give, and the M-Pesa number you choose for payment.
- Payment status: whether a payment succeeded or failed, and its M-Pesa reference. We never see or store your M-Pesa PIN, and money never passes through us.
- Ratings and comments you leave after an order.
- For shop owners and their riders: their WhatsApp numbers and names, the shop's catalog (names, prices, stock, photos) and the shop's settings.
What we use it for
- To answer your questions about the shop's products, prices and delivery.
- To take and deliver your order, send you the payment prompt or payment instructions, and confirm your payment.
- To tell the shop owner and the shop's rider what they need to serve you: your name, your order, your delivery address, and your messages when the assistant hands a question to them.
- To give the shop owner summaries of their sales and of the questions customers asked.
- To send you a shop's offers only if you wrote to that shop. Reply stop at any time and you get no more offers. Reply start to receive them again.
We do not sell your data. We do not use it for advertising, and we do not share it with other shops.
Who processes it for us
- Meta (WhatsApp Business Platform) carries the messages between you and the shop.
- Anthropic provides the AI model that writes the assistant's replies. It receives the conversation and the shop's catalog to write each reply, and does not use them to train its models.
- Safaricom (M-Pesa Daraja) sends the payment prompt to your phone when a shop uses it.
Prices, totals, fees and stock are calculated by our own code, never by the AI model.
Where it is stored and for how long
Your data is stored on a server we control, with nightly backups. We keep conversations and orders while the shop uses BiasharAI, so the shop can serve you and see its history. When a shop stops using BiasharAI, or asks us to clear its data, its conversations and orders are deleted from the live system. A copy of those conversations is kept in a private archive on the same server for the shop's records; it is deleted with your data when you ask us to. Backups older than 30 days are deleted automatically.
Your choices and rights
- Offers: reply stop to a shop to stop its offers, or start to receive them again.
- Access and deletion: write to infos@biasharai.com or on WhatsApp at +33753215331 with the WhatsApp number you used. We will tell you what we hold, and delete your messages, orders and profile within 30 days. Records a shop must keep by law, such as a paid order, are kept only as long as that law requires.
- Under Kenya's Data Protection Act, 2019, you may also complain to the Office of the Data Protection Commissioner.
Data deletion instructions
To delete your data, send an email to infos@biasharai.com with the subject "Delete my data" and the WhatsApp number you used. We confirm by WhatsApp or email once the deletion is done, within 30 days.
Children
BiasharAI is meant for shops and their adult customers. We do not knowingly collect data from children under 18. If you believe a child has written to a shop through us, contact us and we will delete it.
Changes
If this policy changes, we update the date at the top of this page.
